Terms and Conditions

A downpayment of 40% is required to schedule your project. Work in progress is invoiced every 14 days, due upon receipt of invoice.  On the final walk-thru of your project, the remaining balance is due in full. We accept cash or check only.


Damages to underground utilities not marked by Gopher State are at the purchaser's expense.


Warranty and plant replacements: Sculptured Earth Inc. agrees to install plant materials applying correct ANA (American Nursery Association) horticultural standards for workmanship and materials. Should a plant die due to causes other than acts of God, it will be replaced one (1) time free of charge using the same plant material if available. If the same plant material is unavailable, then a similar one will be substituted. New plantings are warranted for one (1) year from the time of installation as to workmanship and materials; payments must be received within the terms of this contract or the warranty is null and void. All plant must receive adequate care andw ater from purchaser or this warranty is null and void.


All pictures taken by Sculptured Earth, Inc. may be used for promotional or advertisement purposes online, in brochures or printed materials, or for any other purpose. The property owner(s) release the rights to these pictures and any compensation for their use by Sculptured Earth, Inc.


THIS IS A NOTICE ONLY AND DOES NOT CONSTITUTE THE FILING OF A LEIN


(A) ANY PERSONS OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS IMPROVEMENT TO YOUR PROPERTY MAY FILE A LEIN AGAINST YOUR PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR THE CONTRIBUTIONS.


(B) UNDER MINNESOTA LAW, YOU HAVE THE RIGHT TO PAY PERSONS WHO SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT DIRECTLY AND DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE, OR WITHHOLD THE AMOUNT(S) DUE FROM US UNTIL 120 DAYS AFTER COMPLETION OF THE IMPROVEMENTS UNLESS WE GIVE YOU A LIEN WAIVER SIGNED BY THE PERSONS WHO SUPPLIED ANY LABOR OR MATERIALS FOR THE IMPROVEMENT AND WHO GAVE YOU TIMELY NOTICE.


Sculptured Earth Inc. and the purchaser hereby agree to the above terms and conditions of this contract.
